DCI, Rights Groups Step In After Surrogacy Dispute Leaves Newborn's Legal Status in Question

 

Police and human rights organizations in Nairobi have been drawn into a surrogacy dispute after a newborn baby was reportedly left stranded with the surrogate mother following a disagreement at a hospital in Upper Hill.



According to the account, the arrangement had been between two close friends: a single mother of two agreed to carry a child for a longtime friend after signing a legal surrogacy contract through a local fertility clinic. However, shortly after a reported 21-hour labour, the intended mother is said to have refused to take custody of the baby.


Witnesses reportedly say the situation grew tense when the intended mother made a phone call asking a relative to come to the ward, then left the room, leaving the surrogate to care for the newborn on her own.


"I went through a difficult pregnancy to help a friend and support my own children, but now I am left with a child who is legally not mine," the surrogate reportedly told reporters outside the hospital.


The Directorate of Criminal Investigations (DCI) is said to be reviewing medical records and the surrogacy contract to determine the appropriate next steps for the child's welfare.
